If someone illegally occupies your property, commonly known as encroachment, Indian law provides several remedies to protect your rights and reclaim possession.
- Civil Suit for Possession (Ejectment Suit):
You can file a civil suit for recovery of possession under Order 39 Rule 1 & 2 of the Code of Civil Procedure, 1908, seeking a temporary injunction and ultimately permanent injunction to evict the encroacher. This is the most common remedy where the court directs the unlawful occupant to vacate the property. - File a Complaint with Local Authorities:
You can approach the local Revenue Department or Municipal Authorities to report encroachment, as they have powers to remove illegal constructions or encroachments on government or private land under respective local laws. - Police Complaint for Criminal Trespass:
If the encroachment involves forcible or unlawful entry, you can file an FIR under Section 441 (Criminal Trespass) and related provisions of the Indian Penal Code (IPC). Police can take action, but often police intervention depends on the nature of possession and if the dispute is civil or criminal. - Summary Eviction under Specific Acts:
In some states, there are specific laws for removal of unauthorized occupants or trespassers. For example, urban local bodies have powers to remove encroachments under municipal laws or the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, if applicable. - Approach the Revenue Court:
For agricultural land, the revenue courts have jurisdiction to decide matters related to land possession and can order eviction of encroachers. - Police Protection During Eviction:
In case of expected resistance during eviction, you can seek police protection for peaceful removal of the encroacher after obtaining court orders. - Preventive Measures:
In certain cases, you can seek anticipatory relief from the court to prevent encroachment before it happens.
